Lottery Draw/Land Sale Regulations

The following outlines our policies for Lottery Draw/Land Sale Regulations.

Corporate Services Committee on September 13, 2004 and City Council on September 20, 2004 concurred with the following recommendations:

  1. All contractors must provide the Land & Properties Department with a copy of their General Contractor's License.
  2. All contractors must be a registered corporation.
  3. All contractors must provide information to the Land & Properties Department outlining their shareholders and directors. A person cannot be a shareholder or director of any other party participating in the lottery sale.
  4. All contractors must have and provide a separate GST number.

It will then become the contractor's responsibility to update our department with any changes.

Mandatory Pre-registration for Land Sale

1) All contractors must be pre-registered with the City of Medicine Hat, Land & Properties Department. This involves providing the following documentation (as outlined above)and signing the Statutory Declaration by the mandatory pre-registration date (as set by Land & Properties and is typically set one week prior to the Land Sale):
a) Copy of General Contractors license
b) Copy of documentation showing that you are a registered corporation
c) List of shareholders & directors (copy of Corporate Search)
d) Copy of documentation from Revenue Canada verifying GST number

2) All individuals must be pre-registered with the City of Medicine Hat, Land & Properties Department. This involves signing the Statutory Declaration by the mandatory pre-registration date (as set by Land & Properties and is typically set one week prior to the Land Sale).

3) The lots will be sold:
a) To those individuals wishing to construct a dwelling solely for their own occupancy. For the purpose of this sale, the word individual shall be deemed to include the spouse of the applicant and only one representative will be permitted. Transfer documentation will only be prepared in the names of the individuals who originally purchased the lot and who signed the "Statutory Declaration".
b) To representatives of contractors; only one representative from each firm will be allowed to participate. A person cannot be a shareholder or director of any other party participating in the Land Sale.

4) One person cannot represent both an individual and a contractor at the same Land Sale.

5) Failure to abide by the conditions of the Statutory Declaration could result in suspension from future lottery sales for a specific period of time (one year). This applies to both the individual and any contractor that is involved in the resale of a lot purchased at this land sale. Also be advised that Clause 6 of the Statutory Declaration states “I acknowledge that it is a criminal offence under the Criminal Code of Canada to make a statement under oath or solemn affirmation knowing that the statement is false”.

If you have not provided the above information to the Land & Properties Department prior to the Pre-registration date for each Land Sale, you will not be eligible to participate as a contractor or individual.

The evening of the Land Sale, the following procedure takes place:

  1. Between 6:30 p.m. and 7:00 p.m. individuals and contractors will choose a number (bingo balls are used). Click here to view the Statutory Declaration.
  2. At 7:00 p.m. the containers will be closed and moved to the draw table where a coin toss will determine whether we draw from the contractors or individuals container first.
  3. If a contractor is drawn first, the next draw will be an individual and vise versa until all contractors and individuals have been drawn once.
  4. After all individuals and contractors have been drawn, contractors will be allowed a second choice. Selection will be in the reverse order of the draw. This will continue until all the lots are sold or all the contractors decline to participate.
